The author first examines scholarly communication and fair use in the print environment, concluding that the former is becoming increasingly inefficient and ineffective and that the latter is a confusing legal doctrine, at best. He then explores pay-per-use technology and the potential difficulties involved in maintaining fair use in a pay-per-view world. While new technologies, such as pay-per-use technologies, could improve certain aspects of scholarly communication, they also could obstruct fair use.
